1. Acceptance of Terms
By accessing or using the Prop Firm Watch Dog website and services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
2. Description of Service
Prop Firm Watch Dog is a community-driven platform that enables users to submit and review cases related to proprietary trading firms. The Service allows users to share their experiences, provide evidence, and vote on submitted cases to help the trading community make informed decisions.
3. User Accounts
3.1. You must authenticate via Twitter/X OAuth to create an account and use certain features of the Service. By connecting your Twitter/X account, you authorize us to access your public profile information as described in our Privacy Policy.
3.2. You are responsible for maintaining the security of your account. You must not share your credentials or allow unauthorized access to your account.
3.3. You must be at least 13 years of age to create an account and use the Service.
4. User-Generated Content
4.1. The Service allows users to submit cases, comments, evidence, and other content ("User Content"). You retain ownership of any User Content you submit, but you grant Prop Firm Watch Dog a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the Service.
4.2. You are solely responsible for the accuracy, legality, and appropriateness of all User Content you submit. Prop Firm Watch Dog does not endorse, verify, or guarantee the truthfulness of any User Content.
4.3. All cases, reviews, and opinions expressed on the platform are those of the individual users and do not represent the views, opinions, or positions of Prop Firm Watch Dog, its owners, employees, or affiliates.
5. Platform Immunity and Section 230 Protections
5.1. Prop Firm Watch Dog operates as an interactive computer service within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. Β§ 230). As such, Prop Firm Watch Dog is not the publisher or speaker of any User Content posted on the platform.
5.2. Prop Firm Watch Dog shall not be treated as the publisher or speaker of any information provided by users. We provide a neutral platform for users to share their experiences and opinions about proprietary trading firms.
5.3. While we may moderate content at our discretion, such moderation does not make us liable for any User Content that remains on the platform. Good faith content moderation efforts do not waive our protections under Section 230.
6. Prohibited Content and Conduct
You agree not to submit, post, or transmit any User Content or engage in any conduct that:
- Defamation: Contains knowingly false statements of fact made with actual malice or reckless disregard for the truth that are intended to harm the reputation of an individual or entity.
- Threats and harassment: Contains threats of violence, intimidation, harassment, bullying, or any content that could reasonably be interpreted as a credible threat to any person or entity.
- Spam and manipulation: Constitutes spam, unsolicited advertising, or attempts to artificially manipulate platform rankings, votes, or case outcomes through coordinated inauthentic behavior.
- Personally identifiable information: Contains private personal information of individuals without their consent, including home addresses, personal phone numbers, financial account details, or government-issued identification numbers.
- Illegal activity: Promotes, encourages, or facilitates illegal activity, or violates any applicable local, state, national, or international law or regulation.
- Impersonation: Misrepresents your identity or falsely implies an affiliation with any person or entity.
- Malicious content: Contains viruses, malware, or any other harmful code or material designed to disrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment.
We reserve the right to remove any content that violates these prohibitions and to take appropriate action against offending accounts, including suspension or termination.
7. Evidence Handling and Storage
7.1. Users may upload screenshots, documents, and other evidence ("Evidence") in support of their submitted cases. By uploading Evidence, you represent and warrant that you have the legal right to share such materials and that they are authentic and unaltered.
7.2. Evidence is stored securely on our infrastructure (Supabase hosted on AWS). We implement reasonable security measures to protect uploaded files but cannot guarantee absolute security.
7.3. Evidence associated with a case may be retained for the duration the case remains on the platform. If a case is removed or a user account is deleted, associated Evidence may be deleted from our systems within a reasonable timeframe, subject to any legal obligations requiring continued retention.
7.4. You acknowledge that once Evidence is submitted and becomes part of a public case, other users may have already viewed or referenced it. Removal of Evidence does not guarantee that copies have not been made by third parties.
8. Rate Limiting
8.1. To maintain platform quality and prevent abuse, users are limited to submitting a maximum of 2 cases per day. This limit resets at midnight UTC.
8.2. Additional rate limits may apply to other actions on the platform, including voting, commenting, and API usage. These limits are subject to change at our discretion.
8.3. Attempts to circumvent rate limits, including the use of multiple accounts, automated tools, or any other means, are prohibited and may result in account termination.
9. Account Suspension and Termination
9.1. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Submission of prohibited content
- Circumvention of rate limits or other platform restrictions
- Engaging in fraudulent or malicious activity
- Extended periods of inactivity (accounts inactive for more than 24 months may be subject to deletion)
9.2. Upon termination, your right to use the Service immediately ceases. We may, at our discretion, remove your User Content from the platform, although we are not obligated to do so.
9.3. You may delete your account at any time through your account settings. Account deletion will remove your profile information and disassociate your User Content from your identity, but previously submitted cases and evidence may be retained in anonymized form.
10. Intellectual Property
10.1. The Service, including its design, features, functionality, and all associated intellectual property rights, is owned by Prop Firm Watch Dog and is protected by copyright, trademark, and other applicable laws.
10.2. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without our prior written consent.
11. Limitation of Liability
11.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2. PROP FIRM WATCH DOG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
11.3. IN NO EVENT SHALL PROP FIRM WATCH DOG, ITS OWNERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
11.4. PROP FIRM WATCH DOG IS NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE BASED ON USER CONTENT OR INFORMATION FOUND ON THE PLATFORM. YOU ACKNOWLEDGE THAT REVIEWS, CASES, AND OPINIONS ARE SUBMITTED BY INDIVIDUAL USERS AND MAY NOT BE ACCURATE, COMPLETE, OR RELIABLE.
11.5. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROP FIRM WATCH DOG'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Prop Firm Watch Dog, its owners, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of any third party.
13. Dispute Resolution
13.1. Informal Resolution: Before filing any formal legal claim, you agree to first contact us at legal@propfirmwatchdog.com to attempt to resolve the dispute informally. We will endeavor to resolve the dispute within 30 days of receiving your notice.
13.2. Binding Arbitration: If the dispute cannot be resolved informally, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.
13.3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13.4. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
14. Changes to Terms
14.1. We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the Service or via other reasonable means.
14.2. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Service.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
